Competition terms and conditions

  1. The Promoter
    The promoter is: Marty Pumbien of 26 Abington Park Crescent, Northampton, NN3 3AD
  2. The Competition
    1. The title of the Competition is
    2. The purpose of the Competition is to win the Prize and to raise money for the Project.
    3. To enter the Competition you need to answer the question correctly.
  3. The Project
    1. The University of Northampton Higher Education Corporation is established under the Education Reform Act 1988 and is an exempt charity under Schedule 3 of the Charities Act 2011 (the University”).
    2. The Project is the dementia research project being conducted by the University known as UnityDEM.
  4. The NCF
    The NCF is the Northamptonshire Community Foundation (a registered charity in England and Wales No. 1094646) NCF is the leading independent grant making charity in Northamptonshire delivering funding for the local voluntary and community sector.
  5. The Question
    The question which entrants to the Competition must answer correctly in order to be eligible to be entered in to the prize draw as set out on the Social Media Pages.

  8. Valuation
    The value of the Prize is estimated at £600,000 but the Promoter does not give any warranty or guarantee to this effect.
  9. How to enter
    1. The competition will run from 3pm on 10 April 2018 (the “Opening Date”) to 5pm on 10 October 2018 (the “Closing Date“) inclusive.
    2. The Promoter reserves the right to extend the Closing Date by up to 1 month and in such circumstances an announcement will be made on the Social Media Pages.
    3. To enter the Competition use your skill and judgment answer the Question and:
      1. send a completed entry form, which can be found on the Social Media Pages by first or second class post to the Promoter at the address specified in clause 1 by the Closing Date. Entry by post is free of charge; or
      2. submit the online entry form on the Social Media Pages and pay the entry fee of £5.00 by the Closing Date.
    4. All competition entries must be received by the Promoter by no later than 5pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    5. Entry into the Competition does not guarantee that you will win the Prize.
    6. The Promoter will not accept:
      1. responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of posting or transmission as proof of receipt of entry to the Competition.
    7. By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.
    8. The Competition entries will be scrutinised by a panel of 3 judges. The names of the judges can be viewed on the Social Media Pages.
    9. All correct answers to the Question will be collated and the winner of the Prize will be drawn at random 14 days after the Closing Date.
  10. Eligibility
    1. 1.1 The Competition is open to individuals who are UK residents or residents of any of the EU jurisdictions listed on the Social Media Pages and who are aged 18 years or over, except for:
      1. immediate family members of the Promoter;
      2. employees or agents or suppliers of the Promoter who are professionally connected and directly associated with the Competition or its administration; or
      3. members of the immediate families or households of (b) above.

      Entries submitted by any of the above people will be invalid.

    2. In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the Competition.
    3. The Promoter will not accept Competition entries that are:
      1. automatically generated by computer;
      2. completed by third parties;
      3. illegible, have been altered, reconstructed, forged or tampered with; or
      4. incomplete.
    4. There is no limit to the number paid online entries to the Competition per person that can be made but only one entry per postal entry is permitted.
    5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
    6. Competition entries cannot be returned.
  11. Conduct of the Competition
    1. In order for the Prize to be won a minimum of 150,000 entries to the Competition must be purchased.
    2. If less than 150,000 entries are purchased by the closing date then a winner will still be drawn in accordance with clause 14 but in that case the Prize will be the cash value of all entries (“the prize fund”) LESS
      1. Reimbursement of the Promoter’s cost and expenses, to amount to no more than 10% of the prize fund.
      2. A donation of 50% of the balance of the prize fund to the University and NCF.
  12. The Prize
    1. If 150,000 or more entries are received for the Competition, the Prize is the residential property at 26 Abington Park Crescent Northampton, NN3 3AD registered title number NN9390.

    3. The Prize is not negotiable or transferable to a third party.
    4. The Prize is transferred subject to all matters which affect the title to the Prize and as described on the Social Media Pages and all other incumbrances which otherwise affect the Prize or the title to the Prize
    5. The Prize will be transferred to the winner free from all financial charges, and an application to register the transfer to the winner at HM Land Registry will be made within 28 days of the Closing Date.
    6. The Promoter will pay the legal fees (limited to a maximum of £1,100 plus VAT) in connection with the preparation and registration of the transfer of the Prize to the winner, stamp duty and other fees and disbursements.
    7. The winner will need to sign the transfer of the Prize in the form prepared by the Promoter before the transfer can be registered at HM Land Registry.
  13. The Project
    1. If 150,000 or more entries to the Competition are purchased but the prize fund does not exceed £2.5 million, the Promoter will, after payment of the Promoter’s costs and expenses incurred in connection with the Competition to amount to no more than 10% of the prize fund, donate 40% of the total prize entry fees to the University and NCF.
    2. 1.1 If the prize fund is £2.5 million or more, the Promoter will donate £1million to the University and NCF.
    3. All donations will be made to the University and the University will contribute 80% of the donation to NCF.
    4. The contribution made to NCF shall be used to set up a designated fund at NCF for the purposes of funding ongoing activities in connection with the Project and will be limited to objectives set by UoN.
    5. The University will use its share of any donation in connection with the Project.
  14. Winner announcement
    1. The winner of the Competition will be announced on the Social Media Pages within 14 days after the Closing Date (Announcement Date).
    2. The decision of the Promoter is final and no correspondence or discussion will be entered into.
    3. The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the Competition entry. The Promoter will not amend any contact information once the Competition entry form has been submitted.
    4. The Promoter will send the name and county of the winner to anyone who writes within one month after the Closing Date of the Competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in clause 1.
  15. Claiming the prize
    1. The Prize may not be claimed by a third party on your behalf.
    2. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their Prize within 14 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
    3. The Promoter does not accept any responsibility if you are not able to take up the Prize.
    4. The winner will be required to provide proof of their identity to the satisfaction of Promoter’s legal advisors before the Prize can be transferred to the winner.
  16. Limitation of liability
    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  17. Ownership of competition entries and intellectual property rights
    1. All Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
    2. By submitting your Competition entry and any accompanying material, you agree to:
      1. assign to the Promoter all your intellectual property rights with full title guarantee; and
      2. waive all moral rights,

      in and to your Competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

  18. Data protection and publicity
    1. If you are the winner of the Competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this Competition and for any other reasonable and related promotional purposes.
    2. You further agree to participate in any reasonable publicity required by the Promoter.
    3. By entering the Competition, you agree that any personal information provided by you with the Competition entry may be held and used only by the Promoter or its agents and suppliers to administer the Competition.
    4. Other than as set out in this clause 18, the Promoter will not transfer or share your personal details with any third party.
  19. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
